General Terms and Conditions
The following General Terms and Conditions valid at the time of the order apply exclusively to all orders from our online shop. Unless we expressly approve deviating conditions of the customer in writing, they shall not be recognised.
§2 Contractual partner, conclusion of contract
The contract shall be concluded with JägerXXL.de owner Georg Schauer, Marktstraße 15, 85405 Nandlstadt (Germany).
The representation of the products in the online shop is not a legally binding offer and should only be regarded as a non-binding online catalogue. You can place our products in your shopping basket and amend your basket at any time before submitting your binding offer by using the amendment tools provided for this purpose and explained during the ordering process.
You will receive a confirmation regarding the receipt of your order by email immediately after placing your order.
You can also print out the order after completion by using the "Print order confirmation now" button.
When the contract is concluded with us depends on your chosen payment method:
Payment in advance
We will accept your order within two days by sending a declaration of acceptance in a separate email, which includes our banking details.
Submit your credit card details at the same time as placing the order. After confirmation that you are the legitimate card holder, we will ask your credit card company to initiate the payment transaction and thereby accept your order.
You will be redirected to the online service provider PayPal's website during the payment process. Here, you can then enter your payment details and confirm the payment instruction to PayPal. After placing an order in the shop, we will ask PayPal to initiate the payment transaction and thereby accept your offer.
After placing your order, you will be redirected to the website of the online service provider paydirekt, where you can confirm the payment instruction for paydirekt. After placing the order, we will ask paydirekt to initiate the payment transaction and thereby accept your offer.
§3 Contractual language, storage of contractual text
The language available for the conclusion of the contract is German.
The contractual text is not stored by us.
§4 Delivery conditions
Shipping costs will be charged in addition to the offered product prices. For details of the shipping costs, see the individual offers.
We are only able to deliver goods; a collection option is unfortunately not available. We do not deliver to packing stations.
We are only able to deliver to addresses in Germany, Austria, Belgium, Bulgaria, Ceuta, Czech Republic, Denmark, El Hierro, Faroe Islands, France, Fuerteventura, Grand Canary, Greenland, Hungry, Italy, La Gomera, La Palma, Lanzarote, Liechtenstein, Luxemburg, Melilla, Netzerlands, Poland, Portugal, Romania, Russian Federation, Slovakia, Spain, Switzerland, Tenerife, and Switzerland.
The following methods of payment are available in our shop:
Payment in advance
If the payment in advance option is selected, we will provide you with our bank details in a separate email and will deliver the goods after receipt of payment.
We are unable to reserve the products which you have ordered until receipt of payment. If these products sell out in the meantime, we shall immediately notify you and refund your payment.
Upon placement of the order, you also send us your credit card details.
Following confirmation that you are the legitimate card holder, we shall instruct your credit card company to initiate the payment transaction immediately after the order has been placed. The payment transaction is performed automatically by the credit card company and your card will be charged.
During the ordering process, you will be redirected to the website of the online service provider PayPal. In order to pay the invoice amount via PayPal, you need to be registered on the PayPal website or register before placing the order, confirm this registration by entering your login details and submit the payment instruction. After placing an order in the shop, we will ask PayPal to initiate the payment transaction. You will receive more information during the ordering process.
The payment transaction is then performed automatically by PayPal immediately after the order is placed.
In rare cases, PayPal may experience systemic delays caused by processing errors or similar issues. We have no control over these delays and are not responsible for the consequences.

§6 Retention of title
The goods shall remain our property until paid for in full.
§7 Damage in transit
If goods are delivered with obvious transport damage, please file a complaint as soon as possible with the delivery company and notify us immediately. If the filing of a complaint or contact with us is delayed, this will have no consequences for your legal rights and their implementation, in particular your warranty rights. By getting in touch right away, however, you will help us to assert our claims against the delivery company or transport insurance company.
§8 Warranty and guarantees
The statutory warranty rights apply, in particular Sections 434 et seq. BGB (German Civil Code). Our liability for damages is governed solely by Section 8 of these General Terms and Conditions. Information about any additional applicable guarantees and their specific conditions are provided for each product and on special information pages in the online shop.

In the case of claims due to damages which were caused by us, our legal representatives or agents, we have unlimited liability in all cases
- for loss of life, limb or health,
- for intentional or grossly negligent breach of duty,
- for warranty promises, where agreed, or
- to the extent that the Produkthaftungsgesetz (Product Liability Act) is applicable.
In the case of the breach of significant contractual obligations which must be fulfilled for the correct execution of the contract at all and if the contractual partner is usually able to rely on their fulfilment (cardinal obligations) due to slight negligence by us, our legal representatives or agents, liability is limited to the level of damages foreseeable upon conclusion of the contract which must typically be expected to be incurred. All other claims for compensation are excluded.

§11 Dispute Settlement
The European Commission provides a platform for online dispute resolution (OS), which can be found here http://ec.europa.eu/consumers/odr/.
We are not obliged or prepared to participate in a dispute settlement procedure before a consumer arbitration board.
§12 Right of cancellation
The right of cancellation is valid for fourteen days from the day on which you, or a third party who is designated by you and who is not the haulage contractor, have taken possession of the goods.
The following provision applies to the case of a contract for several goods, which the consumer has ordered within the framework of a standardized purchase order and which will be delivered separately: the period of cancellation is fourteen days from the day on which you, or a third party who is designated by you and who is not the haulage contractor, have taken possession of the goods.
The following provision applies to the case of a contract about the delivery of goods in several partial consignments or units: the period of cancellation is fourteen days from the day on which you, or a third party who is designated by you and who is not the haulage contractor, have taken possession of the last partial consignment or the last unit.

by means of making a clear declaration in order to exercise your right of cancellation (e.g., a letter that is sent by post, fax or e-mail) about your decision to cancel this contract. You can utilize the specimen copy of the cancellation form that is enclosed for this purpose but this method is not prescribed.
It suffices for complying with the time limit for cancellation that you send the notification about exercising the right of cancellation before the time limit for cancellation expires.
Consequences of the cancellation
If you cancel this contract, then we have to refund all of the payments that we have received from you, including the costs of delivery (except for the extra costs that arise from you having chosen a type of delivery other than the most economical standard delivery which was offered by us), immediately or fourteen days at the latest from the day on which we received the notification about your cancellation of this contract. We will utilize the same means of payment for this repayment that you have used with the original transaction, unless something else has been agreed with your expressly; you will not be charged because of this repayment in any case. We can refuse to make the repayment until we have received the goods back again or until you have provided the proof that you sent the goods back, according to which is the earlier point in time.

immediately or in any case within fourteen days at the latest from the day on which you informed us about the cancellation of this contract. The time limit will be complied with if you sent the goods before the time limit of fourteen days expires.
You bear the direct costs of returning the goods.
You must only pay for any lost value of the goods if this lost value is attributable to your handling of the goods in a way that was unnecessary for checking their quality, specific characteristics and functionality.
End of right of cancellation
Please note: The right of withdrawal shall expire prematurely in the case of contracts for the supply of sealed goods which are not suitable for return if unsealed after delivery for health or hygiene reasons.
§13 Final provisions
The law of the Federal Republic of Germany is applicable, excluding the CISG.
Unless otherwise required by mandatory law, the place of jurisdiction is Nandlstadt.
Should any provision of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision should be replaced with the effective and enforceable provision which most closely reflects the economic intentions of the contractual parties when creating the invalid or unenforceable provision. The above-mentioned provisions shall also apply in the event of a contractual gap.
